ABSTRACT This paper describes the events that occurred in Santiago de Cuba with the insurgent ship Virginius, from November 1st, 1873, when it was captured, until December 26th, 1873, when it foundered in U.S. waters. It analyses the relationship with United Kingdom before the incident, and their support to the Cuban insurgency; it describes the precedents and the capture of the Virginius; the trials by a court martial faced by the crew and the passengers, and the passed and executed death sentences. In an era of gunboat diplomacy, Britain sent the warship HMS Niobe from Jamaica to Santiago de Cuba, when the death penalties had already been executed, and being aware that it had already been decided by Castelar, President of the Executive Power of the Spanish Republic, not to allow the trials to continue, accepting the U.S. requests. Niobe Commander Sir Lambton Lorraine’s actions against Commander Governor of Santiago, General Juan N. Burriel Lynch, only sought notoriety and to date, what happened between them has been misrepresented by historians. Original documents that definitively clarify what happened are transcribed in this paper. It also describes the final phase of the incident, with the turn over of the Virginius to the U.S. Navy, and, as epilogue, it proves that Spain was right and demonstrates the outrage of the United States and United Kingdom.
