entendimiento y el necesario acuerdo en los foros y las normas del más alto nivel internacional como son la Convención sobre las Armas Biológicas y Toxínicas o el propio Estatuto de Roma. Ante esta carencia en la legislación internacional actual, este ensayo aborda la necesidad de un análisis de la realidad normativa y legal sobre las mismas y la de impulsar soluciones en los ámbitos, tanto nacionales como internacionales, para poder paliar esa carencia de forma lo más inmediata posible. Abstract: Society in general is of the opinion that, at this juncture in our history, war crimes have already been perfectly identified and desig-nated. However in the latter case, such a belief is very much at odds with reality, especially as regards certain specific uses. A case in point is the use of biological and toxin weapons. Although a reality that has been widely addressed and regulated both at national and international level, it has not received sufficient attention in terms of pos-sible inclusion among war crimes. Much of the blame for this situation lies with the context of their con-sideration as Weapons of Mass Destruction and the complications surroun-ding the identification and consideration of such weapons. A further reason, however, is the ineffective understanding of the weapons and the need for agreement in forums and norms at the highest international level, including the Biological and Toxin Weapons Convention and even the Rome Statute. In view of this gap in current international legislation, this essay dis-cusses the need for an analysis of the regulatory and legal situation of these weapons and the need also to promote solutions at national and internatio-nal level to remedy the shortcoming as quickly as possible.
